Waiver and Release of Liability

Please read carefully before signing. This is a legal document that affects your rights.

In consideration of being permitted to participate in any training, classes, programmes, or activities (collectively "Activities") provided by Unity 4 Performance Ltd ("the Gym"), located at Unit 3, Mile End Business Park, Oswestry, SY11 4JF, I, the undersigned, acknowledge, agree, and represent the following:

1. Assumption of Risk

I understand that participation in the Activities involves inherent risks, including but not limited to physical injury, illness, disability, or death, which may result from exercise, use of equipment, or other circumstances. These risks may arise from my own actions, the actions of others, or the condition of the facilities. I voluntarily accept these inherent risks of training, whether foreseen or unforeseen.

2. Health Declaration

I confirm that I am in good physical and mental health and have no medical conditions that would prevent my safe participation in the Activities, other than anything I have told the Gym in my health questionnaire (PAR-Q). I have been advised to consult a physician before engaging in any physical exercise programme, and I take responsibility for ensuring my fitness to participate. If I experience any symptoms (e.g., pain, dizziness, shortness of breath) during the Activities, I will immediately stop and inform a member of staff.

3. Release of Liability

To the fullest extent permitted by law, I release, waive, discharge, and agree not to sue Unity 4 Performance Ltd, its owners, directors, employees, contractors, or affiliates (collectively, "the Released Parties") for any injury, loss, damage, or expense arising out of the inherent risks of my participation in the Activities, except where caused by the negligence or breach of duty of the Released Parties. Nothing in this waiver limits or excludes liability for death or personal injury caused by negligence, or any other liability that cannot be limited or excluded by law, and nothing in it affects my statutory rights as a consumer.

4. Indemnity

I agree to indemnify the Released Parties against claims brought by third parties that arise from my deliberate misconduct or my breach of the Gym's rules.

5. Equipment and Facilities

I agree to use all equipment and facilities in line with the Gym's rules and coaching. I will immediately report any damaged or faulty equipment to staff and will not use it if it appears unsafe. I understand that the Gym is not responsible for loss or damage to personal property brought onto the premises, except where caused by its negligence.

6. Governing Law

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising hereunder shall be subject to the jurisdiction of the courts of England and Wales.

7. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

Acknowledgement

I am 16 years of age or over and have read and understood this Waiver and Release of Liability in its entirety. I voluntarily agree to its terms and sign it freely, without duress.

Signing for a youth member (aged 14–16): If I am signing on behalf of a youth member, I confirm that I am 18 or over and their parent or legal guardian. Where this waiver describes taking part, health and following the rules, "I" and "my" mean the youth member. I confirm the health information I have given about them is accurate, I will make sure they understand the Gym's rules, and I accept these terms on their behalf.
